The ACT Civil and Administrative Tribunal has rejected a landlords attempt to raise a tenant’s rent by $85 a week. Empire Global Developments, the landlord and owner of the build-to-rent Marquee Apartment Complex stated during the tribunal the tenant could “move out” if they disagreed with the rent increase. This power imbalance was cited as part of the rejection decision by ACAT.
In 2019, the ACT introduced laws limiting the amount by which landlords can increase rent, making it the only jurisdiction in Australia with such rent increase limits.
ACAT ordered a smaller rent increase of just $35 per week for the tenant.
